Did you know that neither a UK trade mark nor a CTM covers Guernsey in its protection? We have found that many brand owners and their agents are not aware of this and, as a result, have not registered their brand and product names in Guernsey.
Since 2006, it has been possible to protect a trade mark in one of 2 ways in Guernsey. The first is to apply for a primary registration, which is a new filing on the Island. The second is to utilise an existing mark from an approved jurisdiction, such as the UK or the EU and use this as the basis for what is known as a supported registration. In either instance it is also possible to claim priority if filed within 6 months of an existing application or registration.
