Guernsey Image Rights update:
On February 8th 2012 the States of Guernsey released the draft Image Rights legislation for consultation. We are anticipating the implementation of the final legislation during the 2nd quarter of 2012. Image Rights registration with be a world first and will offer owners the ability to formally register their rights. In addition, these will be easily transferable and licensed, just as with other IP rights. IP Lab has been involved throughout the Image Rights process and will offer Image Rights registration as soon as it is possible to do so.

Guernsey is due to implement image rights legislation by the end of the second quarter of 2012. This will enable images to become registered in their own right, without the need to attach these rights to goods and services in the way that trademarks are.
This may prove to be a useful intellectual property right, particularly in the online environment where national boundaries are often blurred. They will also be able to protect marks which are currently difficult to protect, such as endorsements by famous people.
These image rights will also give a much needed clarity to the right itself and will also enable the right to be transferred and licensed easily.
